The Injury Regulation, N.B. Reg. 2003-20 under the Insurance Act, establishes the maximum amount recoverable as damages for the non-pecuniary loss for minor personal injuries resulting from a motor vehicle accident. Pursuant to section 4.3 of the Regulation, the amount is to be adjusted in accordance with the rate of increase in the Consumer Price Index for New Brunswick, commencing January 1, 2015.
Therefore, effective January 1, 2023, the minor injury amount of $8638.35 will be adjusted by 6.3% to $9182.57. The new amount relates to minor personal injuries caused in motor vehicle accidents that occur in New Brunswick on or after January 1, 2023.
